Well, after getting caught running unlicensed software on www.sameoldsaskparty.ca, the comments are coming out.
GiantPoliticalMouse said: Thanks for the hat tip, but I am a little confused. You say that the licencing says, "however you must not remove the links to CMSimple.dk & DotcomWebDesign.com." But the links were not removed, were they? I mean, you point to the fact that the links were working, you click on them to prove the whole crux of your argument. Perhaps the link is now more visible, which is a good thing, but the link was always there, and thus the terms of the license were always complied with. Note the use of the term "more" visible as again, with the mouseovers left intact, the link was always "visible"'
And from the software Developer's License FAQ page:
'I already have a link - does it really have to be visible?
I don't believe in ghosts. When it is stated in the licence, that you need to have a link, of course it has to be visible, readable and useable. Elsewise purchase a commercial licence.'
Nice of you to split hairs, but, like the developer says: 'it has to be visible'. What part of VISIBLE did you NOT understand? What part of 'NO' do you NOT understand?
Furthermore, if the NDP's actions WERE LEGAL, why did the powers that be CHANGE THE WEB SITE so that now the links ARE VISIBLE?
UPDATE
This morning we received the following email from Peter, the developer of CMSimple.dk
'I do not know who are political asses or donkeys in your election, but I believe that, when political parties are using software against the given licence terms, it is a good indication of what kind of disrespect they have for intellectual rights. I would never vote on a party practicing illegal use of software, unless that they would try to settle any error they may have done unintentional by paying compensation to the copyright owners. I haven't been offered niether paid any licence fee for the period of time they have been using my CMS against the free license terms. It seems like this party have no conscience. Sincerely Peter cmsimple.dk'
Lorne, it would appear the developer is seeking his just compensation. Could you or your party open your checkbook and do the right thing?
